1.1. Queen’s Five GmbH, Poststrasse 1, 8001 Zurich (hereafter to be called "Queen's Five") is a company in business of trading decorative articles and articles of furniture (hereafter to be called "Products"). Queen's Five places great worth in highest product quality and absolute customer satisfaction. Queen's Five Products offered to customers are presented on the online platform queensfive.com, queensfive.ch and queens5.ch (hereafter to be called "Online Platform"). Queen's Five might offer the Products for a limited period or quantity.
1.2. All business conditions between Queen’s Five and its customers are governed by these general terms and conditions (hereafter to be called “GTC”). Queen's Five does not accept any other terms and conditions or contracts unless it has been agreed in advance with Queen's Five.
2.1. The minimum required age for registration on the Online Platform is 18 years.
2.2. A person will become a customer of Queen’s Five (hereafter to be called “Customer”) only after the successful registration and acceptance of the GTC on the Online Platform.
2.3. The Customer agrees through the registration on the Online Platform to provide true information and an own and valid e-mail address. Providing of incorrect information will lead to a termination of the membership or an exclusion from the membership.
2.4. After successful registration or conclusion of contract on the Online Platform only Queen's Five is the contract partner of the Customer with regard to the Products ordered on the Online Platform.
2.5. After successful registration the Customer will receive by e-mail a confirmation as well as a password for accessing the Products offered on the Online Platform.
2.6. Only one registration on the Online Platform per person is allowed.
2.7. The Customer commits himself to treat the access information confidentially and to protect from access by third parties.
2.8. Any misuse of the Products or the Online Platform of Queen's Five is punishable and results in termination of the membership. The Customer has to bear all costs that result from the misuse of the Products or the Online Platform of Queen’s Five.
2.9. The Customer commits himself not to provide any information about Queen's Five that could harm Queen's Five or the reputation of Queen's Five.
2.10. The Customer can terminate the membership on Queen’s Five at any time with immediate effect. In such cases, the Customer must contact by e-mail the Customer service of Queen’s Five (here- after to be called “Concierge Service”).
2.11. Queen's Five reserves the right to terminate the membership of the Customer at any time with immediate effect and without any explanations.
3.1. When registering on the Online Platform the Customer can give his consent to receive newsletters as well as commercial information from Queen's Five.
3.2. The contents of the Online Platform can be communicated via additional channels such as SMS, What’s App, mail or push notifications. The Customer can terminate at any time the communication of the additional channels or the Customer can declare the waiver of use of the additional channels in advance to Queen's Five.
3.3. Queen's Five has the right to provide Customer’s data to third parties in order to identify the Customer. Processing of Customer’s data serves only for shipping of the Products and payment process.
3.4. If an unauthorized third party reaches Customer’s data for inexplicable reasons or by force Queen’s Five accepts no responsibility. However, Queen's Five agrees to inform the relevant governmental institutions about the damage and to try to remove the damage as quickly as possible.
4.1. The presentation of Products on the Online Platform is to be understood as "invitatio ad referendum". After selecting the Products the Customer reaches the payment process (by clicking the "Payment" button). The Customer enters the credit card details and thus can send the order and the contract. Subsequently the Customer receives a confirmation of the order and the payment by e-mail from Queen’s Five.
4.2. The confirmation of the order and the payment is the only valid declaration of acceptance of the contract by Queen’s Five.
4.3. There is no minimum order value defined. This does not apply to the use of Coupons, see also Point 7.6.
4.4. The prices on the Online Platform are only valid at the time of Customer's order. After an order has been placed no price reductions or changes to the Products ordered will be considered.
4.5. All prices on the Online Platform are including VAT, unless Queen’s Five makes other references on the Online Platform.
4.6. All prices on the Online Platform are excluding shipping costs.
4.7. For certain Products Queen’s Five may act as a mediator for national or international producers. For orders of such Products the producer may send the Products directly to the Customer. In addition the Customer bears all resulting customs duty and other collected taxes and shipping costs.
4.8. Queen’s Five reserves the right to correct prices that have been displayed incorrectly on the Online Platform for technical reasons. The burden of proof lies on Queen's Five.
4.9. If the Customer already placed a payment for a Product that is incorrectly priced according to Point 4.8, Queen's Five will reimburse the Customer for the payment and retain the Products. Queen's Five will inform the Customer of the incident by e–mail. Offset of payments with other orders is possible.
4.10. If the Customer already placed a payment for ordering a Product that is not available anymore, Queen's Five will reimburse the Customer for the payment and retain the Products. Queen's Five will inform the Customer of the incident by e–mail. Offset of payment with other orders is possible.
4.11. Queen’s Five reserves the right to correct prices before shipping of the Products if the Customer changes the date of delivery set originally by Queen’s Five or places orders of large quantity and thus changes the delivery cost of Queen’s Five. Queen's Five will inform the Customer by e–mail.
5.1.Products are shipped to the Customer by Swiss mail.
5.2.The Customer has the option to pick up the Products personally. In this case the Customer has to contact the Concierge Service in advance.
5.3.The Customer is obliged to examine the ordered Products immediately after their receipt for damage and errors. In case of damage or errors, the Customer should contact the Concierge Service immediately and return the order. Queen's Five will examine the Products returned and decide on further proceedings.
5.4.The Customer has the right to return undamaged Products within 14 days after the receipt. In such cases, the Customer has to complete the return form and indicate the reason for the return. Queen's Five will only accept Products that are undamaged and in original packaging.
5.5. All production orders and/or orders on request cannot be returned.
5.6.Queen’s Five does not replace or refund Products that are damaged by the Customer.
5.7.A return after the specified deadline according to Point 5.4 will not be accepted by Queen’s Five (as evidenced by the postmark).
5.8.If the Customer receives a Product not ordered then the Customer has to return it within 14 days. The cost of returning bears on Queen's Five.
5.9.Queen’s Five only ships Products to the Customer after payment of the order has been placed in its full amount.
6.1.On the Online Platform the Customer can use following payment options: Visa, MasterCard, American Express, PostFinance and PayPal.
6.2.If the Customer picks up an Order in person payment by cash, credit card and Maestro is possible. In this case the Customer has to contact the Concierge Service in advance.
6.3.Payment by invoice (after receipt of the Product) is not possible.
7.1.Coupons which are issued exclusively by Queen's Five (hereafter to be called "Coupons") can be used as payment options only at Queen's Five.
7.2.Coupons are not transferable, can not be combined and can not be used for more than one order. The Customer can not buy Coupons.
7.3.Coupons are not paid back in cash, are not subject to interest and they can not be used for payment of shipping cost.
7.4.Coupons are valid for a specified period. The period of validity can not be extended. After the period specified has expired the Coupons can not be used.
7.5.Coupons can have an intended promotional purpose. In such cases the Coupons can only be used only for Products that are currently offered under the specific promotion.
7.6.Coupons can require a minimum order value. In such cases it is not allowed to place an order below the minimum order value.
7.7.If the value of the order is below the value of the Coupon the difference will not be refunded and cannot be used for another order.
7.8.If the value of the order is above the value of the Coupon the Customer has to pay the difference.
7.9.Queen's Five does not replace any lost Coupons and Queen's Five accepts no responsibility for lost Coupons.
7.10.If an order is returned back to Queen’s Five the value of the Coupon used for the order will not be refunded.
7.11.In case of suspicion of misuse of a Coupon Queen's Five can refuse the delivery of Products. Point 2.8 applies.
8.1.All content in text and picture form on the Online Platform belong exclusively to Queen's Five.
8.2.Without prior written confirmation of Queen’s Five GmbH it is not permitted to copy, reproduce, broadcast or publish, sell or make any other use of any content in text or picture form of the Online Platform.
8.3.If someone believes that the Online Platform shows content that violates a provision of Swiss Law then the Concierge Service should be informed. Queen's Five will investigate on such cases and decide on further proceedings.
9.1.Queen’s Five accepts no responsibility for any damage caused by the use of any information or material from this website or any other websites that are linked to this website.
10.1.The Online Platform can contain references to other websites. Queen's Five has no influence on other websites or their content.
10.2. Queen's Five accepts no responsibility for the content of other websites.
10.3.In case of suspicion of illegal hyperlinks on the Online Platform Queen's Five will investigate on such cases and decide on further proceedings.
11.1. All provisions related to business with Queen’s Five are in compliance with Swiss Law.
11.2.Competent court for all disputes between the Customer and Queen's Five is the seat of Queen's Five. Mandatory competent courts remain reserved.
12.1.Queen's Five reserves the right to change the GTC at any time. All changes will be published on the Online Platform with effect as of the date of publishing on the Online Platform.
